David Farkas

David is a business litigator with a practice that spans a wide range of industries, including health care, banking, real estate, insurance, construction and mass transit. He has represented his largely institutional clients in varied complex commercial matters in federal and state court raising claims of fraud, government false claims, breach of contract, breach of fiduciary duty, legal malpractice, business torts, unfair competition, defamation, and libel. David also has experience in employment matters, defending actions for wrongful termination, misappropriation of trade secrets, and other violations of federal and state employment laws. His responsibilities include trial examination, taking and defending depositions, drafting and arguing pleadings, motions and other briefing, managing all discovery, including e-discovery, negotiating complex settlements, and pre-litigation counseling.
Before joining Coleman Frost, David was in-house counsel for Health Net, Inc., defending Health Net in claims disputes, other healthcare-related matters, insurance coverage disputes, and commercial litigation matters. He also developed and coordinated strategy with outside counsel on larger matters and advised business teams regarding legal and regulatory risk. David started his legal career at Nossaman LLP, eventually becoming a Senior Associate working on the firm’s largest cases involving hundreds of millions of dollars in dispute. He litigated an array of complex commercial matters in federal and state court, helping his clients to efficiently obtain favorable outcomes.
David obtained his J.D. and a Certificate in Dispute Resolution from Pepperdine University School of Law in 1999. While at Pepperdine, he received the American Jurisprudence Award for Federal Courts and earned the Dean’s Award. David graduated with a B.A. in Political Science in 1993 from the University of Richmond, where he was a member of the Golden Key National Honor Society, the Pi Sigma Alpha National Political Science Honorary Society, and the Dean’s List. David is fluent in French.
